These Pool Service Terms & Conditions apply to recurring and related pool services provided by Turtle Pool Care LLC. By signing or electronically accepting these terms, authorizing service, or paying an invoice that references these terms, the customer agrees to the terms below.

1. Recurring Pool Service

Recurring pool service is provided on a month-to-month basis unless otherwise agreed in writing.

Your monthly service price is for ongoing pool care and is not based on receiving an exact number of visits in every calendar month.

Service schedules may vary because of holidays, weather, route changes, access issues, emergencies, equipment conditions, or other circumstances described in these terms.

Turtle Pool Care determines route scheduling and the normal service day for each property.

2. Regular Weekly Service

Depending on the customer's service plan and pool conditions, regular service may include:

  • Testing and balancing pool water
  • Adding normal maintenance chemicals as needed
  • Emptying accessible skimmer and pump baskets
  • Brushing pool surfaces as needed
  • Skimming debris as conditions require
  • Vacuuming or other routine cleaning as appropriate
  • Inspecting visible pool equipment for obvious operating issues
  • Maintaining normal sanitizer levels
  • Providing service reports or photographs where available through our service system

The exact work required at an individual visit depends on current pool conditions.

3. Normal Chemicals Included

Normal quantities of standard pool-maintenance chemicals required to maintain the pool under ordinary operating conditions are included when included in the customer's service plan.

Normal chemical usage does not mean unlimited chemical usage.

Extraordinary quantities of chemicals, salt, specialty treatments, stain treatments, phosphate treatments, stabilizer, or other products may be required because of conditions outside normal weekly maintenance.

Examples include:

  • Extreme or prolonged rainfall
  • Flooding or significant storm-water intrusion
  • Large amounts of fresh water entering the pool
  • Pool draining or partial draining
  • Significant water replacement
  • Leaks or abnormal water loss
  • Overflow conditions
  • Equipment failure
  • Extended circulation problems
  • Contamination
  • Construction debris
  • New pool or resurfacing conditions
  • Customer-directed water replacement
  • Conditions caused by another service provider
  • Other unusual events that materially alter pool chemistry

When extraordinary chemical replacement is required, Turtle Pool Care may charge separately for unusually large quantities of chemicals or salt.

For example, severe rainfall or water replacement can substantially dilute the salinity of a saltwater pool and may require multiple 40-pound bags of salt to restore the proper operating range.

Where practical, we will notify the customer before incurring a significant additional chemical or salt charge.

Routine weekly chemical adjustments remain included as provided by the customer's service plan.

4. Weather and Unsafe Conditions

Pool service is performed outdoors and is affected by weather.

Turtle Pool Care determines when weather or site conditions make normal service ineffective, impractical, or unsafe.

Conditions may include:

  • Heavy rain
  • Lightning or thunderstorms in the area
  • Flooding
  • Excessive standing water
  • High winds
  • Tropical storms
  • Hurricanes
  • Tropical storm or hurricane watches or warnings
  • Unsafe road conditions
  • Inaccessible yards or properties
  • Other hazardous conditions

During moderate rain or when conditions permit safe access, Turtle Pool Care may perform a reduced or chemical-only service rather than a full cleaning.

When thunder or lightning is present or nearby, technicians may avoid using poles and other equipment that could create a safety hazard.

When rainfall, flooding, wind, lightning, or other conditions become too severe for effective or safe service, service may be stopped or postponed.

A weather-affected visit may therefore consist of:

  • Water testing
  • Chemical treatment
  • Equipment observation
  • Limited cleaning
  • Chemical-only service

rather than a normal full cleaning.

5. Severe Weather and Extraordinary Rainfall

Major rainfall and flooding can materially change pool water chemistry even when the pool was properly balanced before the storm.

Large volumes of rainwater may:

  • Dilute chlorine and other sanitizer levels
  • Reduce salt concentration
  • Reduce stabilizer levels
  • Change pH and alkalinity
  • Introduce contaminants and debris
  • Cause pools to overflow
  • Increase algae risk

Turtle Pool Care will make reasonable efforts to restore normal water conditions during subsequent service.

When restoration requires unusually large quantities of salt, chemicals, specialty products, additional visits, pumping, cleanup, or other work beyond normal recurring maintenance, those extraordinary materials or services may be charged separately.

6. Missed or Modified Service Due to Weather

Recurring monthly service is not priced on a per-visit basis.

A visit that must be modified, shortened, postponed, or omitted because of severe weather or unsafe conditions does not automatically result in a credit or reduction of the monthly service charge.

When practical, Turtle Pool Care may provide chemical-only service, limited service, reschedule work, or otherwise adjust the route based on conditions.

If a customer believes a full cleaning is particularly necessary following a weather event, the customer may contact Turtle Pool Care. We will make a reasonable effort to accommodate the request based on route capacity, weather, and safe working conditions.

7. Holiday Service

Turtle Pool Care may operate a reduced-service schedule during Thanksgiving week and Christmas week.

During these periods, we may provide chemical-only or limited service when needed to maintain water quality.

Customers who require a full cleaning during one of these holiday periods may request one. We will make a reasonable effort to provide full service based on scheduling and operating conditions.

The regular monthly service charge continues during these periods.

8. Customer Access

The customer is responsible for providing safe and reliable access to the pool and pool equipment on the scheduled service day.

This includes, where applicable:

  • Unlocked or accessible gates
  • Current gate codes
  • Guard-gate authorization
  • Keys or lockbox access
  • Safe access around the property
  • Securing animals that could interfere with service

If the technician cannot safely or reasonably access the pool, Turtle Pool Care may be unable to complete some or all of the scheduled service.

An inaccessible property does not automatically result in a service credit.

Customers should notify Turtle Pool Care promptly when gate codes, locks, access procedures, or other access conditions change.

9. Pets and Animals

Customers are responsible for identifying pets or animals that may be present in or near the service area.

Animals that may escape, interfere with service, or create a safety concern should be secured before the technician arrives.

Turtle Pool Care is not responsible for an animal escaping through a gate that must reasonably be opened to perform service when the customer has not provided appropriate instructions or safeguards.

10. Pool Water Level

The customer is generally responsible for maintaining an appropriate pool water level unless otherwise agreed.

Low water levels can prevent pumps and other equipment from operating correctly and can cause equipment damage.

Excessive water levels caused by rain, flooding, automatic-fill problems, or other conditions may also interfere with pool operation and chemistry.

Water addition, draining, pumping, or other water-level correction beyond routine service may be separately chargeable when substantial work is required.

11. Equipment Condition

Recurring pool service does not constitute a warranty that pool equipment is in good condition or will not fail.

Pumps, motors, filters, heaters, automation systems, salt systems, valves, plumbing, lights, electrical components, and other equipment may fail because of age, wear, improper installation, electrical issues, weather, corrosion, prior repairs, or other causes.

If we observe an apparent equipment problem, we will generally notify the customer.

Repairs, replacement parts, diagnostic work, and equipment upgrades are separate from normal recurring pool service unless expressly included in the customer's plan.

Turtle Pool Care may recommend that equipment be repaired when a malfunction prevents us from maintaining the pool properly.

12. Existing Conditions and Staining

Turtle Pool Care is not responsible for pre-existing:

  • Surface staining
  • Scale
  • Plaster deterioration
  • Cracks
  • Etching
  • Discoloration
  • Metal staining
  • Calcium buildup
  • Structural defects
  • Equipment deterioration

Routine water treatment may reveal conditions that were previously obscured by algae, debris, scale, or other buildup.

Stain-removal treatments, acid washing, metal treatment, resurfacing, and similar corrective work are separate services unless specifically included.

13. Green Pools and Corrective Treatments

A pool that is green, heavily contaminated, severely unbalanced, or otherwise outside normal maintenance condition may require a separate Green-to-Clean or corrective treatment.

Recurring weekly service pricing does not automatically include the labor or chemical quantities required to restore a severely neglected or contaminated pool.

Additional treatment, visits, chemicals, filter cleaning, or related work may be separately quoted or charged.

14. Filter Cleaning and Maintenance

Routine basket cleaning does not necessarily include periodic deep cleaning, cartridge replacement, DE-grid service, sand replacement, filter disassembly, or repairs.

Where additional filter maintenance or cartridge replacement is required beyond the customer's normal service plan, Turtle Pool Care may recommend or quote that work separately. The customer is responsible for timely approval of recommended filter maintenance or replacement when the existing filter condition materially affects circulation, filtration, sanitation, or our ability to properly maintain the pool.

15. Customer Changes to Pool Chemistry

Customers should notify Turtle Pool Care before adding substantial quantities of chlorine, acid, salt, stabilizer, algaecide, metal treatment, phosphate treatment, or other pool chemicals.

Uncoordinated chemical additions can create unsafe or unstable water conditions and may interfere with our treatment program.

Turtle Pool Care is not responsible for water-balance problems caused by chemicals or treatments added by the customer or another party without our knowledge.

16. Repairs and Additional Work

Repairs, equipment installation, upgrades, specialty cleaning, stain treatment, green-pool restoration, leak-related work, and other services outside normal recurring maintenance may be separately quoted or billed.

Authorization may be provided by:

  • Written approval
  • Email
  • Text message
  • Electronic acceptance
  • Other clear customer authorization

17. Customer Approval of Repairs and Maintenance Recommendations

Some equipment repairs, replacement parts, filter cartridges, filter cleaning, or other corrective work may be necessary for Turtle Pool Care to properly maintain the pool.

When Turtle Pool Care provides a repair recommendation, work order, estimate, or request for authorization, the customer is responsible for reviewing and approving or declining the recommended work within a reasonable period of time.

Certain conditions may require prompt action, including:

  • Failed or poorly operating pumps
  • Inadequate filtration or circulation
  • Worn, damaged, or excessively dirty filter cartridges
  • Failed salt systems or chlorination equipment
  • Leaks or abnormal water loss
  • Equipment problems that prevent proper sanitation or water circulation
  • Other conditions that may cause water quality to deteriorate or equipment damage to increase

Delays in approving necessary repairs, filter cartridge replacement, or other recommended corrective work may result in poor water quality, algae growth, increased chemical consumption, equipment damage, or the need for additional corrective service.

Turtle Pool Care is not responsible for deterioration of pool water, increased chemical usage, algae, equipment damage, or other conditions caused or materially contributed to by a customer's delay or refusal to authorize reasonably recommended repairs or maintenance.

If an unresolved equipment or filtration problem prevents Turtle Pool Care from reasonably maintaining the pool, additional chemicals, filter cleaning, corrective treatments, Green-to-Clean service, additional visits, or other work may be separately chargeable.

If the condition continues to prevent reasonable maintenance of the pool, Turtle Pool Care may suspend or discontinue recurring service until the necessary repair or corrective work has been completed.

18. Billing and Payment

Recurring service is billed at the agreed monthly rate.

Invoices are due according to the payment terms shown on the invoice or otherwise agreed with the customer.

Additional approved work, extraordinary chemicals/materials, repairs, or specialty services may appear as separate charges.

Failure to maintain an account in good standing may result in suspension or termination of service.

19. Price Changes

Turtle Pool Care may change recurring service pricing from time to time.

Customers will receive reasonable notice before a recurring price change takes effect.

Continuing service after the effective date of the new pricing constitutes acceptance of the updated recurring rate.

20. Cancellation

Recurring service is month-to-month unless otherwise agreed.

Either the customer or Turtle Pool Care may terminate recurring service.

Amounts already due for completed service, approved repairs, materials, chemicals, or other work remain payable after cancellation.

21. Service Suspension or Termination

Turtle Pool Care may suspend or discontinue service for reasons including:

  • Nonpayment
  • Unsafe property conditions
  • Repeated inability to access the pool
  • Aggressive or unsafe animals
  • Abusive or threatening conduct
  • Equipment conditions preventing reasonable service
  • Conditions materially different from those represented when service was accepted
  • Other circumstances that make continued service unsafe or impractical
